Welcome to aiNGo (“aiNGo”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website (aingo.ai), the aiNGo Customer Portal, our AI voice and text leasing-agent services, telephony integration, and our Property Management integrations (collectively, the “Services”).
By registering for an account, purchasing a subscription, accessing the Customer Portal, connecting your Property Management System (such as Rent Manager), or using any part of the Services, you (“Customer”, “Property Manager”, or “You”) agree to be bound by these Terms and by our Privacy Policy, Fair Usage Policy and Refund Policy, which are incorporated by reference. If you are using the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. If you do not agree, do not use the Services.
The Services are intended for businesses and are not directed to individuals under 18 years of age.
aiNGo provides an AI-powered voice and messaging agent and automation platform designed for property management companies, landlords, and real estate operators. The Services include:
We may add, change, or remove features from time to time. We will use reasonable efforts to notify you of material changes that reduce the core functionality of your plan.
3.1. You must provide accurate, current, and complete information during registration and keep it up to date.
3.2. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, including activity by your staff and anyone you give access to.
3.3. You must promptly notify aiNGo at aingollc@gmail.com of any unauthorized use of your account or any security breach.
4.1. Plans. The Services are sold as subscription plans with a monthly or annual billing cycle and an included allowance of call minutes and features, as described on our pricing page at the time of purchase.
4.2. Automatic renewal. Subscriptions are billed in advance and renew automatically at the end of each billing period, at the then-current price for your plan, until you cancel. By subscribing you authorize us and our payment processor (Stripe) to charge your payment method on each renewal date. If a payment fails, we may retry the charge and may suspend the Services until payment is received.
4.3. Cancellation. You may cancel your subscription at any time from your account on aingo.ai (My Account / Customer Portal → Subscriptions or Settings → Billing) or by emailing aingollc@gmail.com. When you cancel, your account remains active until the end of your current paid billing period and you will not be charged again. Cancelling does not entitle you to a refund of the current period except as stated in our Refund Policy.
4.4. Refunds. All payments are non-refundable except as expressly provided in our Refund Policy (for example, annual plans cancelled within 14 days of the initial purchase). Phone number procurement fees, carrier registration fees, and billed call minutes are non-refundable.
4.5. Usage and overages. Telephony usage, call minutes, or feature add-ons exceeding your plan allowance will be billed in accordance with our Fair Usage Policy and published pricing. We may limit or pause usage that exceeds your plan until you upgrade or the next billing period begins.
4.6. Plan changes and price changes. You may upgrade or downgrade your plan at any time; changes take effect as described at checkout. We may change our prices with at least 30 days’ notice; the new price applies from your next renewal after the notice period.
4.7. Taxes. Prices exclude any applicable taxes, which you are responsible for unless we state otherwise.
You agree not to, and not to allow others to:
We may suspend or terminate accounts that violate this section.
6.1. The Services use artificial intelligence to understand callers and texters and to respond on your behalf. AI responses may be incomplete, inaccurate, or misunderstood by callers, and the AI may occasionally fail to answer, book, or record a conversation. You should review call summaries, transcripts, and bookings regularly and correct any errors with your prospects and tenants.
6.2. You are responsible for the accuracy of the information you provide to the Services, including unit availability, rents, fees, amenities, pet policies, screening criteria, and showing times, whether entered directly or synced from your Property Management System. The AI agent relays that information to prospects.
6.3. You are solely responsible for compliance with the federal Fair Housing Act and applicable state and local fair-housing and anti-discrimination laws in how you configure and use the AI agent, including any qualification questions, screening criteria, and listing descriptions. aiNGo does not provide legal advice and does not guarantee that any configuration is compliant.
6.4. The AI agent is not a substitute for your own judgment. Leasing decisions, lease terms, and tenant communications remain your responsibility.
7.1. Call recording. The Services record and transcribe calls. You acknowledge and agree that it is your responsibility to comply with all applicable local, state, federal, and international wiretapping and call-recording consent laws (including one-party and two-party/all-party consent jurisdictions), including by enabling appropriate recording disclosures for the jurisdictions you operate in.
7.2. Automated AI disclosure. You agree that aiNGo may disclose to callers and texters that they are speaking or texting with an automated or AI assistant in accordance with applicable law and regulatory guidelines.
7.3. SMS and texting. Where the Services send text messages to your prospects or tenants (for example, showing confirmations and follow-ups), you are responsible for obtaining and documenting any consent required under the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, CTIA messaging guidelines, carrier requirements, and applicable state laws, and for honoring opt-out requests (such as STOP). You must not use the Services to send marketing messages to anyone who has not consented. Our texting terms for recipients are published at aingo.ai/sms.
7.4. Carrier registration. SMS delivery requires carrier registration (such as A2P 10DLC) of your business and messaging use case. You agree to provide accurate information for that registration and acknowledge that carriers may delay, filter, or block messages outside our control.
7.5. Outbound calls. If you use the Services to place outbound calls, you are responsible for complying with the TCPA, the National Do Not Call Registry, and all applicable calling-time and consent requirements.
8.1. As part of your subscription, aiNGo may provision one or more telephone numbers through our telephony providers for use with your AI agent. These numbers are provided for use during your active subscription and remain controlled by aiNGo and its providers; you do not acquire ownership of a number.
8.2. You may request to port a number out when your subscription ends, subject to carrier rules and any outstanding balance. Numbers may be released and reassigned 30 days after a subscription ends.
8.3. Number procurement and carrier registration fees are non-refundable. We may replace a number if it is reclaimed by a carrier or if required for compliance.
9.1. By supplying your Rent Manager or other PMS API credentials, you grant aiNGo permission to read and write tenant records, unit statuses, appointments, and work orders on your behalf, solely to provide the Services.
9.2. aiNGo is not responsible for any downtime, data sync delays, or API outages originating from third-party PMS providers.
9.3. The Services rely on third-party providers, including telephony and SMS carriers, AI model providers, payment processing (Stripe), and hosting and analytics providers. Your use of those services through aiNGo is subject to their terms, and we are not responsible for their availability, accuracy, or acts and omissions. Where you connect a third-party service to aiNGo, you represent that you are permitted to do so.
10.1. You retain ownership of the data you and your callers provide to the Services, including call recordings, transcripts, listing data, and contact information (“Customer Data”). You grant aiNGo a license to host, process, and use Customer Data to provide, secure, support, and improve the Services, consistent with our Privacy Policy.
10.2. You are responsible for providing any notices to, and obtaining any consents from, your prospects, tenants, and staff that are required for us to process their information on your behalf.
10.3. We retain Customer Data for the duration of your subscription and for a reasonable period afterwards, after which it may be deleted. You may request export or deletion of your Customer Data by contacting aingollc@gmail.com.
aiNGo retains all rights, title, and interest in and to the platform, AI models, prompts, software, algorithms, designs, and documentation. You receive a limited, revocable, non-exclusive, non-transferable license to use the Services during your active subscription for your internal business purposes. If you provide feedback or suggestions, we may use them without obligation to you.
12.1. These Terms apply from the moment you first use the Services and continue while you have an account.
12.2. You may cancel your subscription at any time as described in Section 4 or by contacting support at aingollc@gmail.com.
12.3. aiNGo may suspend or terminate your access, with notice where practicable, if you breach these Terms or our Fair Usage Policy, if your payment is overdue, if your use creates a security, legal, or carrier-compliance risk, or if we discontinue the Services. On termination, your right to use the Services ends, provisioned phone numbers may be released as described in Section 8, and Sections 6, 7, 10–16 survive.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, aiNGo DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. aiNGo DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT EVERY CALL OR MESSAGE WILL BE ANSWERED, RECORDED, OR DELIVERED, THAT AI RESPONSES WILL BE ACCURATE, OR THAT USE OF THE SERVICES WILL RESULT IN ANY PARTICULAR NUMBER OF LEADS, SHOWINGS, OR LEASES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, aiNGo AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR AI AGENT CALL OR MESSAGE OUTCOMES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. aiNGo’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO aiNGo FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless aiNGo and its officers, employees, and suppliers from and against any claims, damages, fines, penalties, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your Customer Data or listing information; (b) your use of the Services in violation of these Terms or applicable law, including call-recording, TCPA, SMS-consent, and fair-housing laws; (c) your dealings with your prospects, tenants, and staff; or (d) your breach of any third-party terms you are subject to.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction. Before filing a claim, you agree to contact us at aingollc@gmail.com and attempt in good faith to resolve the dispute for 30 days.
We may update these Terms from time to time. The “Last updated” date at the top shows when the current version took effect. For material changes we will notify you by email or through the Customer Portal before they take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
These Terms, together with the policies referenced in them, are the entire agreement between you and aiNGo regarding the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be sent to the email address on your account.
For questions regarding these Terms, contact aiNGo at aingollc@gmail.com.
